Arirang Mass Games 2009 wrap up

North Korea has wrapped up its Arirang festival, a two month-long mass gymnastics extravaganza, media outlets reported Tuesday.

The festival drew about 1.4 million people from home and abroad since it opened in August at the May Day Stadium in Pyongyang, according to the Korean Central Broadcasting Station, a North Korean radio network.

The 80-minute show was held daily except on Sundays after opening on Aug. 10.

North Korea has held the festival, named after the famous Korean folk song, almost annually since 2002. It features synchronized acrobatics, gymnastics, dances and flip-card mosaic animation. Performed by about 100,000 people, it is believed to be the largest gymnastics show in the world.

ORIGINAL POST: North Korea’s Mass Games (100,000 person gymnastics spectacle) began yesterday.

Mass Games used to be held only on special anniversaries (5, 10, 15, 60, etc.) of special holidays such as the end of the Korean War (Victory in the Fatherland Liberation War), Founding of the Worker’s Party, etc.  Since 2005 (when yours truly watched the show with Kim Jing il), however, the games have been hosted annually.

Although the themes and names of Mass Games performances have changed over the years, this specific performance called “Arirang” has been running since 2002—with slight modifications.

According to the AFP, this year the theme Kangsong Taeguk  (powerful and prosperous nation) was added to the performance. This of course reflects the policy goals the government hopes to achieve by 2012, Kim Il sung’s 100th birthday.

Pyongyang, August 11 (KCNA) — The grand gymnastic and artistic performance “Arirang” for this year started at the May Day Stadium Monday.

The creating staff and performers succeeded in re-representing the extravaganza in a brief span of time; they newly created Scene I of Act III and enriched it with fresh contents more truthfully representing the great mental power and skills of the Korean people and the appearance of the country that has undergone tremendous changes.

Among the audience were servicepersons and people from all walks of life, diplomatic envoys and representatives of international organizations here, foreign guests and overseas Koreans.

The performers made an impressive grand epic representation of Juche Korea that has risen high as a dignified sovereign power after putting an end to the history of the nation’s sufferings under the leadership of President Kim Il Sung and the unshakable faith and will of the army and people of the DPRK to build a great prosperous and powerful socialist nation guaranteeing the eternal prosperity of the nation under the Songun leadership of Kim Jong Il.

The performance was highly acclaimed by the audience for presenting fantastic scenery with a good combination of dynamic mass gymnastics and graceful artistry, ever-changing peculiar background scenes, stage decor and a variety of electronic displays.

Further thoughts:
1. This is one of the few times American tourists are able to visit the country. I recommend as many Americans as possible do so.  Based on personal experience, I know that many in the DPRK do not believe the propaganda they are told about Americans.  North Korea’s third generation is now coming of age and these individuals have neither seen a military conflict with the US nor personally known a relative killed in the Korean War.  The kids in particular are very curious.

2. The western media tends to assume the motivation for the mass games is pure propaganda for both a domestic and international audience–“come and see how united our people are”.  Although this might be compelling strategy, I can’t help but to be reminded of the great economic history book by Fogel and Engerman, Time on the Cross, about slavery in the Southern United States.

In the book, the authors discuss the strategy of plantation owners to create a number of cottage industries and tasks which were not terribly economical, however, they kept the slaves occupied so they did not have time to organize or pursue other sorts of goals that could lead them to “trouble”.  I am beginning to feel the same way about the Mass Games.  Kids who are not in school are ripe for trouble-making and the development of individual pursuits, so why not keep them busy all summer producing “wholesome” goods like the mass games?

“150 Day Battle” production campaign stories

North Korean claims record production gains through ‘150-day battle’

It has been boasted that North Korea’s ‘150-day Battle’ to boost the economy (April 20-September 16) resulted in record-breaking jumps in DPRK production numbers, and it has been suggested that that by 2012, some enterprises will “attain production numbers higher than the best numbers recorded at the end of the 1980s.” This claim was made by Ji Young-il, the director of the Chosun University Social Science Research Institute, which is run by the pro-Pyongyang “General Federation of Korean Residents in Japan.”

In “Professor Ji Young-il’s Monthly Economic Review: The 150-day Battle and Prospects for Building an Economically Powerful Nation,” an article in the federation’s newspaper, Choson Sinbo, the author wrote, “There are more than a few enterprises that have set production goals for 2012 at more than three times the current level of production.” He also claimed that some enterprises in the mining, energy and railroad transportation sectors had set goals of as much as 6 times today’s production numbers.

Professor Ji went on to write, “Basically, it is an extraordinary goal ensuring growth of 1.3-1.5 times (a growth rate of 130-150%) per year.” He also explained that surpassing production rates as high as those seen in the late 1980s is one of the fundamental markers on the road toward “opening the door to a Strong and Prosperous Nation.”

Citing North Korea’s “Choson Central Yearbook,” he gave production numbers in various sectors of the DPRK economy at the end of the 1980s: electricity, 55.5 billion kWh (1989); coal, 85 million tons (1989); steel, 7.4 million tons (1987); cement, 13.5 million tons (1989); chemical fertilizer, 5.6 million tons (1989); textiles, 870 million meters (1989); grain, 10 million tons (1987).

Director Ji claimed that during the recent ‘battle’, production in the metals industries was up several times that of the same period in previous years, while energy producers generated several hundred million kWh of electricity, coal production was up 150%, and cement and other construction materials were up 140%. He pointed out that in 14 years of the Chollima movement, beginning in 1957, during which socialist industrialization took place in the North, the yearly average production growth was 19.1%, and he stated that the annual growth of 9 to 10% in industrial production over the past several years was a noteworthy record.

Moving to the agricultural sector, Director Ji also noted that while overseas experts have critiqued this year’s harvest, there has been a definite breakthrough in grain production with land cultivation hitting previously unseen levels over the past several years.

DPRK admits sanctions pressure, stresses frugality

The March 2009 issue of the North Korean Journal Economic Research emphasized that with the strengthening of international economic sanctions against the North, actively participating in the “Battle for Savings” was essential in all sectors in order to construct a “strong and prosperous nation.”

The recently obtained academic journal called on readers to broaden the “savings battle” in an article titled, “Strongly Spreading the Battle for Savings Is an Important Measure for the Construction of an Economically Strong Socialist Nation.” The article stressed that the “savings battle” was necessary for the successful completion of large-scale industrial construction projects, such as the Huicheon Power Plant, as well as the construction of hundreds of thousands of private homes and pubic facilities. North Korean authorities consider these projects essential to the successful construction of a ‘strong and prosperous nation’ by 2012, the year marking the 100th anniversary of the birth of the late Kim Il Sung.

The journal reported that Kim Jong Il had ordered, “Instances of waste among workers and laborers is to be eliminated and the Battle for Savings strengthened.” It also offered, “The ‘Battle for Savings’ is one of the conditions necessary to be able to overcome the economic difficulties created by the Imperialists’ sanctions.”

The journal accused the United States of “villainously daring to carry out military pillaging and economic sanctioning measures” in order to blockade the North and reported that “American and Japanese Imperialists are not only sanctioning imported and exported goods, but are going as far as to interfere with loan accounts.” These statements may provide some insight into the economic and social difficulties the international sanctions are causing for North Korea.

The article went on to say that these circumstances demand that all people “Raise the revolutionary spirit of self-reliance and strenuous efforts while strengthening to new heights of the savings battle throughout all sectors of the People’s Economy.”

Furthermore, it stated that if the “Battle for Savings,” was strengthened, “The capital saved could increase the number, quality and variety of products, increasing the export base,” and, “foreign capital can be saved by closely managing and efficiently using materials which must be imported, such as crude petroleum and some raw materials and equipment.”

The article also evaluated the implementation of savings plans in factories and enterprises, stating, “Pilot projects to increase production need to be expanded through schemes such as prizes and money for saving of raw materials and increasing output by introducing overtime pay schedules.”

Reform from Below: Behavioral and Institutional Change in North Korea

Abstract: The state is often conceptualized as playing an enabling role in a country’s economic development—providing public goods, such as the legal protection of property rights, while the political economy of reform is conceived in terms of bargaining over policy among elites or special interest groups. We document a case that turns this perspective on its head: efficiency-enhancing institutional and behavioral changes arising not out of a conscious, top-down program of reform, but rather as unintended (and in some respects, unwanted) by-products of state failure. Responses from a survey of North Korean refugees demonstrate that the North Korean economy marketized in response to state failure with the onset of famine in the 1990s, and subsequent reforms and retrenchments appear to have had remarkably little impact on some significant share of the population. There is strong evidence of powerful social changes, including increasing inequality, corruption, and changed attitudes about the most effective pathways to higher social status and income. These assessments appear to be remarkably uniform across demographic groups. While the survey sample marginally overweights demographic groups with less favorable assessments of the regime, even counterfactually recalibrating the sample to match the underlying resident population suggests widespread dissatisfaction with the North Korean regime.

North Korea names new head of public finance

North Korea’s Supreme People’s Assembly Standing Committee has removed Kim Whan-su from his position as head of public finance, naming Pak Su-kil as the new financial chief and giving him the title Deputy Prime Minister. This news was carried by (North) Korea Central Broadcasting on September 18.

This brings the number of North Korean deputy prime ministers to five, and the inclusion of the prime minister of public finance is meant to further strengthen public finance capacity. This is but one more indication of the importance North Korean authorities have placed on economic reform policies and the establishment of a Strong and Prosperous Nation by 2012. The other four deputy prime ministers are Kwak Bum-ki, Pak Myung-sun, Rho Du-chul, and Oh Su-yong.

This latest reshuffle was ordered through a Standing Committee ordinance. With the approval of the cabinet prime minister and at times when the SPA is not in session, the Standing Committee has the power to appoint cabinet members, department heads, committee chairs and deputy prime ministers.

The head of public finance is responsible for the national budget, but the national budget is limited to the ‘people’s economy’, and does not include the ‘second economy’ run for and by the military. It is the military budget that actually makes up the majority of the nation’s financial dealings. Therefore, despite the naming of the new vice prime minister, it is expected to be difficult to see any substantial change in the implementation of the national budget.

It is not yet known what led to the removal of former financial chief Kim Whan-su. It is possible that his dismissal resulted from poor returns on the nation-wide ‘150-day Battle’, which was brought to a conclusion on September 17. The naming of the new chief and empowering him as a deputy prime minister may be an attempt to squeeze more production out the ‘100-day Battle’ which is expected to commence soon.

The reports on the appointment made no mention of Pak Su-kil’s personal situation, but it is likely that this is the same Pak that has been repeatedly appointed by the SPA as the committee chairman of the North Hamgyong Province People’s Committee. Chairman Pak is known to have risen to the provincial chair position from his former role as chairman of a county administrative economy committee.

North Korea shuffles cabinet in effort to build a strong and prosperous nation

In order to meet the goal of building a ‘Strong and Prosperous Nation’ by the year 2012, North Korean authorities are reshuffling some positions within the Cabinet, which is its ‘Economic Headquarters’. During the first session of the 12th Supreme People’s Assembly (SPA) last April, Kim Jong Il launched his third regime, and now less than 6 months later, is restructuring the Cabinet. For example, the National Science and Technology Council, which was merged into the Cabinet Academy of Science (now the National Academy of Science) in 1998, has been re-established.

North Korean media briefly reported on the 19th that the SPA Standing Committee brought out the “Democratic People’s Republic of Korea National Science and Technology Council” through the announcement of Government Ordinance # 301. The press did not follow up with specifics concerning the announcement, but the recent position of North Korean authorities that “without scientific and technological development, there is no independence, no national defense, and no economy,” it appears that the recent cabinet order is related to attempts by the North to strengthen its economy.

The first National Science and Technology Council established in the North was created in 1962, and was intended to support the national defense industries. The Academy of Science, which had been established 10 years prior, was put under the control of the council, and the council was responsible for the creation and implementation of a national science and technology plan, as well as for providing guidance over research activities. However, as the North’s level of science and technology improved, the council, which was not made up of experts on science and technology, was unable to appropriately guide the research carried out by the academy. In 1982, the academy was separated from the council, and its status was boosted to that of an independent entity.

North Korea is currently in its 3rd 5-year plan to “develop new national science and technologies” by 2012. Currently, North Korea is prioritizing the modernization of factories, enterprises and other industries, and Kim Jong Il has stressed modernization and the introduction of vanguard technologies during his on-site inspections of the nation’s economic facilities. Therefore, it appears that the newly established National Science and Technology Council will be responsible for overseeing cooperation between mechanical and chemical industries and the modernization of the industrial sector, while the National Academy of Science will focus purely on research.

Juche and North Korea’s Global Aspirations

In his latest publication, Armstrong details the DPRK’s short-lived and ultimately unsuccessful efforts to establish a global presence in the 1970s. These efforts included attempts at economic engagement with advanced capitalist countries and a diplomatic offensive in the Third World.

According to Armstrong, the ultimate failure of North Korea’s pursuit of what later came to be termed “globalization,” can be attributed to the contradiction between the stated policy of juche, or self-reliance, and the “necessary requirements for engagement in the international system, particularly the global economy.”

2009 bad year for Kaesong Zone

UPDATE 9/16/2009: Despite the downward trajectory that business in the Kaesong Zone seemed to be taking this year, things appear to have bottomed out.  According to Yonhap, the Koreas have signed a Kaesong wage increase.  According to the article:

South and North Korea agreed to a 5 percent wage hike at a joint industrial park on Wednesday, the Unification Ministry here said, in the latest sign of inter-Korean projects returning to normal.

North Korea earlier demanded a 400 percent raise in monthly wages for its workers at the South Korean-run park in Kaesong, just north of the border.

South Korea’s management office in Kaesong “signed an agreement on a 5 percent wage increase” with its North Korean counterpart, ministry spokesman Chun Hae-sung said in a brief statement.

The North voluntarily withdrew its earlier demand last week in a striking shift from its unyielding attitude in four rounds of negotiations from April to July. The demand called for monthly wages be raised to US$300 from the average $70-80, apparently in retaliation against Seoul’s hard-line policy toward Pyongyang.

The Kaesong park opened in late 2004 as an outcome of the first inter-Korean summit four years earlier. It houses 114 mostly small-sized South Korean firms producing clothing, electronic equipment, kitchenware and other labor-intensive goods with about 40,000 North Korean workers.

The venture is seen as a much-needed source of dollar income for the North, which is currently under U.N. sanctions for its May nuclear test that bans cash flows to the country.

The 5 percent rate hike will increase the minimum wage to about $58 from the current $55.

Separately, North Korea was conducting a door-to-door survey on South Korean businesses at the joint park, said ministry spokeswoman Lee Jong-joo.

North Korea asserted that the two-day survey that continues until Thursday was to examine the firms’ output and “listen to their complaints and difficulties regarding tax and accounting,” Lee said. Such on-site surveys have been done sporadically, she added.

Although tensions might have eased, it remains to be seen whether the business community can be coaxed into making serious capital investments in the DPRK.

DPRK banks’ role strenghtened to increase security of personal holdings

The latest issue of the Kim Il Sung University newspaper (2009, no. 2, April) acknowledged the international society’s sanctions against North Korea, and in a bid to encourage a self-determinant resolution to the country’s economic problems, the paper called for “the utmost circulation of dormant cash,” emphasizing the role of the bank.

The paper stressed that strengthening the role of the bank was a crucial part of ensuring the country’s socialist system continued to operate. It also stated that elevating the position of the bank and circulating currency were essential elements of ensuring that North Koreans were not reliant on foreign assistance, and that they were able to solve their problems independently.

In the article encouraging currency circulation, it was stated that “the oppressive isolation policy of the imperialists grows worse every day,” but that by maximizing capital circulation, domestic economic problems could be resolved and the North could complete its bid to create an economically strong nation even more quickly.

The article reflects the DPRK government’s attempt to encourage spending of Won, Dollars, and Euros by institutions, enterprises and even individuals in an attempt to ease economic woes even in the face of international sanctions. Jung Yeon-ho, a researcher with the Korea Development Institute (KDI), reported in 2003 that North Koreans were sitting on as much as 600,000-1,000,000 USD. Since 2003, North Korean authorities have been trading US dollars for Euros due to sanctions from Washington, so now many in the North also have considerable amounts of Euros stashed away, as well.

Kim Il Sung University, through its paper, insisted that banks needed to strengthen their role in currency circulation and lending, and to ensure that their services were in line with the demands of the times. It noted that banks were taking note of the needs of individuals and enterprises, and catering to their demands in order to more appropriately respond to their issues and not only meet their needs, but to encourage their continued use.

Some North Koreans have had bad experiences with banks, not being able to withdraw previously deposited funds or not earning expected interest. This has led some to avoid banks in order to guarantee their savings.

After the North’s July 1st (2002) Economic Management Reform Measure, an attempt to make policy reflect reality in the North, the government began selling 10-year ‘People’s Lifestyle Bonds’. In early 2006, North Korea’s banks began offering savings accounts, loans, and other services to individuals and enterprises in order to encourage spending.

The trial of US journalists and North Korean criminal law

Detention of U.S. Journalists

Korean-American Euna Lee (Lee Seung-eun) and Chinese-American Laura Ling, reporters for the U.S.-based Current TV, were detained by North Korean soldiers on March 17, 2009 while near the Tuman River border between North Korea and China. On June 8, the Central Court, the highest court in North Korea, sentenced each of the two to an unprecedented 12 years of ‘Reform through Labour.’ However, after less than two months, a visit by former U.S. President Bill Clinton on August 4 led to the ‘special pardon’ of the two women, bringing a relatively swift conclusion to their plight.

What laws were enforced against the two American reporters? North Korean criminal code article 69 (Jo-seon-min-jok-Jeok-dae-joi, or literally, Korean Nation Antagonism Crime) states, “If a foreign person resides abroad with the intention of antagonizing Korea or injuring the body or assets of a sojourning Korean, or if national discord arises, they shall be faced with a sentence of more than 5 and less than 10 years of Reform through Labour (Ro-dong-Ky-ohwa-hyeong). In serious circumstances, [the person] faces a sentence of more than 10 years Reform through Labour.” Criminal Law article 233 (Illegal Border Crossing) dictates that “A person illegally crossing the national border faces less than 2 years of labor discipline (Ro-dong-dan-ryeon-hyeong). In serious circumstances, [the person] faces less than 3 years of reform through labour (Rodong Kyohwa-hyeong).

North Korea’s Criminal Procedures and the Accused’s Right to Council

The North Korean legal system maintains a 3-tier, 2-trial system. That is, the courts are divided into three levels, but actually, trials may only be heard twice. However, in the case of the two reporters, the trial was directly handled by the Central Court, meaning that only one trial would be held, and there was, of course, no chance to appeal.

Examining the North’s judicial system and criminal law, one can see that the DPRK constitution divides power among the Central Court, Provincial Courts, People’s Courts, and Special Courts (Constitutional Law, article 153). In addition, according to North Korea’s Criminal Procedure Law, the Central Court was established in order to handle appeals when verdicts handed out by lower courts were challenged (Criminal Procedure Law, article 129, clause 1), and it was designated the supreme court in the North Korea (Constitutional Law, article 161). The law also allows for the direct intervention of the Central Court, or for a case to be sent to a court on the same level or of the same kind as the court giving the initial verdict (Criminal Procedure Law, article 129, clause 2). Furthermore, according to the system established by these codes, after a case is opened in one of these courts, it must be completed within 25 days (Criminal Procedure Law, article 287). In the case of the two American reporters, the prosecution received notice of their charges on May 14, meaning that if they were to be prosecuted, the trial would have to have been completed by June 7.

When the Central Court holds the initial hearing in a prosecution, there are two possibilities for retrial. Only “in the event that it becomes known that the evidence upon which a decision is based was false,” or, “facts become known that could influence a decision and that were not known at the time of the trial,” can a Central Court case be reheard (Criminal Procedure Law, article 409). The decision to retry is in the hands of the North’s judicial authorities, meaning that it would have been difficult to find a route to appeal or retrial for the two reporters.

The verdict in an initial trial is decided by a judge and two civilian jurors, although in special cases a panel of three judges is allowed (court organization law, article 9). Any North Korean citizen with the right to vote can be a judge or civilian juror (Court Organization Law, article 6), and judges and jurors are chosen through democratic elections (Court Organization Law, article 4). A criminal case in North Korea follows a process of investigation, pretrial hearing, indictment, and trial (in that order). A detention order must be signed by a public prosecutor within 48 hours of a suspect’s arrest, and charges must be filed within 10 days (Criminal Procedure Law, article 144, clause 1).

The two reporters were apprehended March 17, and were not transferred to the court until May 14, almost two months later. According to North Korean law, a preliminary hearing must be held within two months of opening a pre-trial investigation (Criminal Procedure Law, article 151, clause 1). If investigators want to extend the investigation period, they must receive permission from a public prosecutor, and then can only extend the investigation for an additional two months (Criminal Procedure Law, article 152). Charges of crimes against the state or against the nation are investigated by the State Security Department (Criminal Procedure Law, article 124). In the case of Lee and Ling, investigators did not apply for an extension, and handed the case over to the courts within the allowed two-month period.

The North Korean constitution guarantees a public trial and the guaranteed the right of defense, although in some cases courtrooms are allowed to be closed (Constitutional Law, article 158). The constitution also guarantees that a foreigner will be able to speak in their native tongue during a hearing (Constitutional Law, article 159). A defendant has the right to choose their legal counsel, and that choice can include family members or a representative from work (Criminal Procedure Law, article 108), as well as the freedom to waive their right to council (Criminal Procedure Law, article 109). The right to choose one’s lawyer is directly related to one’s basic freedoms. In the case of the two American reporters, Laura Ling retained council, while Euna Lee chose not to be represented or give any statement.

The North Korean Central Court sentenced Lee and Ling to ten years of reform through labour for ‘Korean Nation Antagonism Crime’ (Criminal Law, article 69) and an additional four years for illegally crossing into the country (Criminal Law, article 233). However, in the North, in the case of multiple charges, the sentence for the more minor charge is halved, then added to the sentence of the more serious offence, meaning a 12-year sentence for the two reporters. This sentence was to begin within 10 days of the verdict. North Korean law dictates that reform through labour be carried out in reform institution (Judicial Conduct Law, article 25). When a defendant is sentenced, they are to be sent to a reform institution within 10 days, along with a copy of the court’s decision, detention orders, and all other relevant paperwork (judicial conduct law, article 33). This, in a nutshell, is the North Korean legal system, from arrest to starting to serve a sentence.

Kim Jong Il’s Power of Pardon and the Release of U.S. Journalists

When North Korea released the two U.S. reporters, the government claimed to do so based on its “humanitarian and peace-loving policy,” and stated that former President Clinton’s visit deepened understanding and helped to build trust between Washington and Pyongyang. This was an interesting use of Kim Jong Il’s power of pardon. It appears that last April, at the first session of the 12th Supreme People’s Assembly, there was a constitutional revision that transferred the ability to grant pardons from the SPA Presidium to the Chairman of the National Defense Commission (NDC). According to a ‘report’ of Clinton’s visit released by North Korean authorities on August 5, “In accordance with the Socialist Constitution Article 103, pardon is granted to two U.S. reporters sentenced to reform through labour; the Chairman of the National Defense Commission of the Democratic People’s Republic of Korea passed down the order for [their] release.”

After the previous constitutional revision, coinciding with the launch of the Kim Jong Il regime in September 1998, article 103 clause 5 specified the duties and powers of the chairman of the NDC, but there was no mention of the ability to pardon. However, article 110, clause 17, which defines the duties and powers of the SPA Presidium, states that it “exercises the right to grant general amnesties or special pardon.” In the past, when pardons were granted on national holidays or in conjunction with other important events, they were done so in the name of the SPA Presidium. North Korea has yet to publicize what constitutional changes were made in April, but with the release of the two Americans in the name of Kim Jong Il, it can be seen that the ability to grant general amnesty has been transferred to the NDC chairman. Earlier, on May 22, the Japanese newspaper Nikkei (日本經濟新聞) quoted members of a delegation from the Economic Research Institute for North East Asia (ERINA) as saying that their North Korean counterparts had explained that the power to ratify and nullify treaties, to grant amnesty, and to issue announcements in times of emergency had been transferred to the chairman of the NDC.
